Terms of Service · M College

These Terms govern your use of M College (the “Service”), provided by M College Technologies Pvt. Ltd. (“we”, “us”). By signing up, you accept these Terms.

1. Acceptance of Terms

By clicking “Start free trial”, creating an account, or accessing the Service, you confirm that (a) you have authority to bind your college, and (b) you've read and accept these Terms and our Privacy Policy.

2. The Service

M College is a multi-tenant SaaS platform that includes modules for admissions, attendance, fees, exams, hostels, transport, library, HR, and more. Specific modules enabled for your college depend on your subscription plan.

We reserve the right to add, modify, or remove features with reasonable notice. Material downgrades will be communicated at least 30 days in advance.

3. Your account

You're responsible for all activity under your college's account.
Account owners must be authorised representatives of the institution (e.g., Principal, Registrar, authorised IT administrator).
Keep credentials secure. Notify us immediately at security@mcollege.in on any suspected compromise.
One subscription per legal entity. Sharing accounts across institutions violates these Terms.

4. Acceptable use

You agree not to:

Upload or process content that's unlawful, infringing, or violates others' privacy.
Attempt to access other colleges' data, reverse-engineer the platform, or probe security.
Use the Service to send bulk unsolicited communications outside your institutional audience.
Resell, sublicense, or white-label without our written permission.
Use automated scrapers / bots except through our documented API with valid credentials.
Interfere with service integrity — DoS, malicious payloads, resource abuse.

We can suspend accounts that violate these rules, with notice where feasible.

5. Fees & billing

Subscription fees are per the plan selected at signup or as modified by written agreement.
Fees are billed annually unless monthly billing is specifically enabled.
All fees are exclusive of GST, which is added at the prevailing rate.
Invoices are payable within 15 days. Overdue accounts may be suspended after 30 days.
Price changes apply to renewals; existing paid terms are honoured at the original rate.
Refunds are issued for verifiable service failures per our SLA, not for change-of-mind.

6. Trial period

Free trials run for 14 days unless otherwise stated. No credit card is required to start. At the end of the trial, your account is downgraded to a read-only state — data remains accessible for 30 days while you decide. After 30 days of inactivity post-trial, data may be deleted.

7. Your data

You retain all ownership of data you upload or create in the Service.
You grant us a limited licence to host, copy, transmit, and display the data solely to provide the Service.
We act as your data processor for student / faculty records. See Privacy Policy.
You can export all your data at any time (CSV, SQL dump, JSON).
On cancellation, data is retained for 30 days then deleted (except audit logs required by statute).

8. Intellectual property

The Service — software, design, logos, documentation — is our IP and licensed, not sold, to you. You may not copy or modify our code.

Any feedback or suggestions you send us may be used without obligation. If we incorporate your idea, we'll still own the resulting implementation.

9. Warranty disclaimer

The Service is provided “as is”, with commercially reasonable effort. We disclaim all implied warranties — merchantability, fitness for a particular purpose, non-infringement.

Our SLA commits to 99.9% uptime. Credits for breach are the exclusive remedy.

10. Limitation of liability

To the maximum extent permitted by law, our total aggregate liability for any claim under these Terms is limited to the fees you paid us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages, including loss of data (provided we followed our backup commitments), loss of revenue, or reputational harm.

11. Indemnification

You agree to indemnify us against third-party claims arising from (a) your misuse of the Service, (b) content you uploaded that violates third-party rights, or (c) your violation of applicable law.

12. Termination

You can cancel at any time from your account settings. Pro-rata refunds apply only for annual plans, subject to a 30-day notice.
We may terminate immediately for material breach of Acceptable Use or non-payment after reasonable notice.
Upon termination, your data is retained for 30 days for recovery, then deleted.
Sections on Data, IP, Warranty, Liability, Indemnity, and Law survive termination.

13. Governing law & disputes

These Terms are governed by the laws of India. Disputes are subject to the exclusive jurisdiction of the courts of Ahmedabad, Gujarat.

For disputes under ₹5 lakh, parties agree to try good-faith negotiation for 30 days before filing.

14. Changes to these Terms

We may revise these Terms from time to time. Material changes will be communicated at least 30 days before effective date via email to account owners and notice on the platform. Continued use after the effective date constitutes acceptance.
